Every week we get the same message. Someone wants to upgrade the front end of their BMW, they have seen a set of headlights online for a fraction of dealer money, and they want to know one thing before they spend: will these get me pulled over or fail an MOT?
The honest answer is that it depends entirely on what you are buying. Here is how the law actually works, in plain English, so you can tell the difference between a legal upgrade and an expensive paperweight.
The short answer
There are two completely different things people call "aftermarket headlights", and the law treats them very differently.
Bulb conversions are not legal. Pushing an LED or HID bulb into a housing that was designed around a halogen filament is not road legal in the UK and is an MOT failure. It does not matter how expensive the bulbs are or what markings are on the box.
Complete replacement units carrying a valid E mark are legal. The whole lamp has been approved as a single assembly: light source, reflector, lens and beam pattern together, tested as one thing.
That second category is what we sell, and it is worth being specific about the swap our customers are actually doing. These are not halogen cars. Our units replace factory xenon and factory LED headlights on cars that already came with projector lighting from BMW. You are going from one complete approved unit to another complete approved unit, which is the route the regulations allow. That is a very different situation from someone shoving an eBay bulb kit into a reflector housing.
Why bulbs and complete units are treated differently
A headlight housing is engineered around the exact size, shape and position of one specific light source. The reflector or projector geometry is designed to throw that source into a controlled beam with a sharp cut off, so you can see the road without blinding oncoming traffic.
Change the light source without changing the optics and the light is coming from the wrong place, in the wrong shape. The cut off softens or disappears. The result looks brighter to you sitting behind the wheel, is genuinely worse at lighting the road, and dazzles everyone coming the other way.
That is why the rule exists, and why the MOT records it as a light source and lamp that are not compatible. It is not bureaucracy for its own sake.
A complete unit sidesteps the problem entirely because nothing is being retrofitted into the wrong optics. The lamp was designed as an LED lamp from the start and approved as one.
What the E mark actually tells you
The E mark is the approval mark used across the UNECE regulations. You will see it as a capital E in a circle followed by a number, for example E4 or E11.
Two things people commonly get wrong:
The number is the country that approved it, not a quality grade. E4 is the Netherlands, E11 is the United Kingdom, E1 is Germany. All approvals follow the same UNECE test criteria, so an E4 mark is not inferior to an E11 mark.
The regulation number matters more than the E number. Complete headlamp assemblies are approved under regulations covering full lamp units. Replacement bulbs are approved under separate bulb regulations, and crucially there is no approval category that authorises an LED replacement for an H4, H7 or H11 halogen bulb. It does not exist. If a seller quotes a lamp unit regulation on a box of bulbs, treat it as a red flag.
Coming off factory xenon: the bit most sellers skip
This is the part that actually catches people out, and almost nobody selling headlights will tell you about it.
If your car left the factory with xenon headlights, it very probably also left with a headlamp washer system and a levelling system. Those were part of the original approved package. The washer jets are in the bumper. The levelling sensors are on the suspension.
Here is the MOT rule that matters. Washer and levelling systems are not failed for being absent, but they are failed for being fitted and not working. So when you swap the units, the question is not "do the new lights have levelling" but "is anything still bolted to my car that now does nothing".
In practice that means three things:

If your bumper has headlamp washer jets, they need to still work after the swap. Do not blank them off and forget about them.

If the car throws a levelling fault after the swap, get it resolved rather than living with the warning. An inoperative system that is still fitted is the thing that fails.

Get the beam aimed properly once everything is in. This is the single most common reason a perfectly legal set of lights still fails an MOT.
Worth being straight about our own product here: our units do not have automatic levelling, and they do not reproduce adaptive cornering or swivel. That is not a legality problem in itself, because the MOT does not require a levelling system to be present. It does mean you should have the beam set correctly at fitting and leave it there.
What an MOT tester actually checks
Tyres and brakes get the attention, but lighting faults are one of the most common MOT failure categories in the UK. On the front of the car the tester is looking at:

Operation. Both dipped beam and main beam work, both sides, every time. Main beam must ignite immediately when selected.

Security and condition. No cracked lenses, no water ingress, nothing hanging loose.

Colour. Light emitted must be white, predominantly white with a blue tinge, or yellow. Anything clearly blue or purple fails.

Aim. The beam must have a proper cut off and be aimed correctly. Too high dazzles, too low means you cannot see.

Matched pair. Both sides should emit substantially the same colour and intensity. One new unit and one old unit is a problem.

Levelling and washers, if fitted. Only failed if they are present on the vehicle and not working.
Notice what is not on that list: the brand of the lamp, whether it came from BMW, or whether the car has been modified. The test is about the physical result.
DRL colours: what you can and cannot run
Colour switchable DRLs have exploded in popularity since BMW put yellow running lights on the M3 and M4 CSL. A lot of aftermarket units, including ours, let you cycle the DRL through white, yellow, amber and red.
The rules on front facing lamps come down to colour, and the line is clearer than most people think.
White is fine. It is the default and what the vast majority of cars run.
Yellow is fine. Selective yellow is a long standing permitted colour for forward facing lighting in the UK and across Europe. It is not a loophole, it is a recognised category, and BMW themselves type approved yellow running lights on the CSL cars. If you like the look, run it.
Amber is not. Amber is reserved for direction indicators. A static amber light showing forward is not what the regulations allow, and it can genuinely confuse other drivers about whether you are about to turn.
Red is not. Red showing to the front is specifically prohibited. This one goes beyond the MOT and becomes a police matter, because a red light at the front of a vehicle is associated with emergency services.
So the practical position: white or yellow on the road, whichever you prefer. Save amber and red for static display, shows and content. The switching is a feature, not a licence.
Coding, warning lights and error messages
This comes up constantly and it is worth separating out, because it is not a legality question at all.
When you change headlight units, some cars will throw a warning on the dash or a lighting error, because the car is expecting a different current draw or a different module response from the unit that left the factory. That is an electrical handshake between the car and the lamp, not a compliance issue. A properly specified unit for your chassis should be plug and play. If a particular car will not accept them, the fix is coding, not different lights.
What it does tell you is that the version matters. The same chassis was built with more than one factory lighting setup, and ordering the wrong version is the most common self inflicted problem we see. If you are unsure which you have, send a clear photo of the front of your current headlights before you order. Not the connector plug, the actual lights. It takes thirty seconds and saves a fortnight.
A buying checklist
Before you spend anything, work through this:

Is this a complete headlight unit or a set of bulbs going into your existing housing? If it is bulbs, stop.

Does the unit carry an E mark on the lamp itself, not just on the packaging or in the marketing copy?

Is it listed for your exact chassis and your exact factory lighting version? Xenon and LED cars are not always the same part.

Are your washer jets and levelling accounted for if you are coming off factory xenon?

Is there a warranty, and is it with a UK seller you can actually reach? A twelve month warranty means very little if the seller is a drop shipper with no returns address.

Does the seller tell you what the lights do not do? Any listing claiming a budget aftermarket unit matches every factory function is worth a second look.
FAQ
Are aftermarket headlights illegal in the UK? No. Complete replacement headlight units carrying a valid E mark are legal to fit and use. Bulb conversions into a housing designed for a different light source are not.
Will aftermarket headlights fail an MOT? A correctly specified, E marked complete unit that is securely fitted, working and correctly aimed should not fail on the grounds of being aftermarket. Poor aim is the most common reason a legal set of lights still fails, so get them aligned after fitting.
Are yellow DRLs legal in the UK? Yes. Yellow is a permitted colour for forward facing lighting and BMW type approved it themselves on the CSL cars. Amber and red are not permitted showing to the front.
Can I replace factory xenon headlights with LED units? Yes, provided you are fitting a complete E marked LED unit rather than converting the xenon housing. Check that any headlamp washers still on the car continue to work, since a fitted system that no longer functions is a major defect.
Do I need coding for aftermarket headlights? Usually not. A unit built for your chassis should be plug and play. Some cars will still throw an error, in which case remote coding resolves it.
How do I know which version fits my car? Photograph the front of your existing headlights and check against the listing before you buy. Chassis alone is not enough.
